A homeowners association put a lien on the property of a resident because she refused to pay the association dues. When she ignored the lien, the homeowners association foreclosed on her home. An attorney, the insured in this case, provided legal advice to the homeowners association and assisted with the foreclosure action. The resident sued both the homeowners association and the attorney alleging improper notice and seeking punitive and other damages. She also alleged that the attorney conspired with the homeowners association and the other entities involved to deprive her of her property, causing emotional distress. The insured attorney is now a defendant to an action by an adversary of his client.
